Tenant Bicycle Parking in Existing Commercial Buildings Ordinance - Exception Request 

An owner, lessor, manager, or other person who controls a building may apply to the San Francisco Environment Department for an exception to the Tenant Bicycle Parking in Existing Commercial Buildings Ordinance if:  
  • The building's elevators are not available for bicycle access because unique circumstances exist involving substantial safety risks directly related to the use of such elevators, or
  • The exemption applicant has access to (i) secure, alternate and covered off-street bicycle parking or (ii) secure alternate indoor no-cost bicycle parking that meets the security requirements of Planning Code Section 155.1 (a)(6) or (7) (see below), and such parking facility is available on the premises or within three blocks or 750 feet of the building, whichever is less,  that accommodates all tenants of the building requesting bicycle access. 
The San Francisco Environment Department will provide a determination on the application after consultation with the Department of Building Inspection and the Municipal Transportation Agency. The Department of Building Inspection may conduct an inspection of the building to determine if bicycle access does pose a safety risk. 

If the exception request is granted: 
An owner, lessor, manager, or other person who controls a building shall post the granted exception from the SF Environment Department, or post a notice indicating that the granted exception is available in the office of the building manager, with information about where the alternative secure bicycle parking is located. 

If the exception request is denied: 
Bicycle Access Plan shall be posted within 20 days of notification of denied request.

SEC. 155.1. BICYCLE PARKING REQUIREMENTS FOR CITY-OWNED AND LEASED BUILDINGS.
(a) Definitions.
  • (6) Class (1) Bicycle Parking Space(s). Facilities which protect the entire bicycle, its components and accessories against theft and against inclement weather, including wind-driven rain.
    Examples of this type of facility include (1) lockers, (2) check-in facilities, (3) monitored parking, (4) restricted access parking, and (5) personal storage.
  • (7) Class 2 Bicycle Parking Spaces(s). Bicycle racks which permit the locking of the bicycle frame and one wheel to the rack and, which support the bicycle in a stable position without damage to wheels, frame or components.
